ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION AGREEMENT

PLEASE READ THIS DOCUMENT CAREFULLY. BY SUBMITTING THIS FORM, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY LOSS.

1. ASSUMPTION OF RISK
I acknowledge that participation in Brazilian Jiu-Jitsu, martial arts, grappling, self-defense training, and related physical activities involves inherent risks of physical injury, including but not limited to: sprains, strains, fractures, dislocations, concussions, lacerations, contusions, muscle tears, ligament damage, spinal injuries, paralysis, cardiovascular events, and in rare cases, death. I understand that these risks may arise from the actions, inactions, or negligence of myself, other participants, instructors, or third parties, and that not all risks can be foreseen or eliminated. I voluntarily choose to participate with full knowledge and acceptance of these risks. I certify that I (or the minor participant) am physically fit and have no medical conditions that would prevent safe participation, or I have obtained physician approval to participate.

2. WAIVER AND RELEASE OF LIABILITY
In consideration of being permitted to participate in the Activities, I hereby voluntarily release, forever discharge, and agree to hold harmless Apache Warrior Academy, Apache Warrior Youth Foundation, Inc., their owners, officers, directors, employees, agents, instructors, volunteers, affiliates, and assigns (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, arising out of or in any way connected with my participation in the Activities, including but not limited to claims arising from the negligence of the Released Parties. This release does not apply to claims arising from the gross negligence or willful misconduct of the Released Parties.

3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to my participation in the Activities, or any breach of this Agreement, whether caused by my acts or omissions or those of third parties.

4. MEDICAL AUTHORIZATION AND EMERGENCY TREATMENT
I authorize the Released Parties to seek and obtain emergency medical treatment on my behalf (or on behalf of the minor participant) in the event of injury or illness during participation in the Activities. I understand that I am solely responsible for all costs associated with such medical treatment. I agree to disclose any relevant medical conditions, allergies, or medications to the instructors prior to participation.

5. RULES AND CONDUCT
I agree to abide by all rules, regulations, and instructions provided by Apache Warrior Academy instructors and staff. I understand that failure to comply with safety rules may result in immediate removal from the Activities without refund. I agree to report any unsafe conditions or injuries to the instructors immediately.

6. PHOTOGRAPHY AND MEDIA RELEASE
I grant Apache Warrior Academy and its affiliates the irrevocable right to photograph, video record, and use my image and likeness (or that of the minor participant) in any media format for promotional, advertising, educational, and commercial purposes without further notice, compensation, or consent. I waive any right to inspect or approve the use of such images.

7. MINOR PARTICIPANTS
If the participant is under the age of 18, I, as the parent or legal guardian, represent that I have the legal authority to execute this Agreement on behalf of the minor. I agree that the terms of this Agreement shall be binding upon the minor, myself, and our respective heirs, estates, and assigns. I accept full responsibility for the minor's conduct and participation in the Activities.

8. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Gonzales County, Texas. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

9. ENTIRE AGREEMENT AND ACKNOWLEDGMENT
This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof. I acknowledge that I have read this Agreement in its entirety, understand its contents, and submit it voluntarily. I understand that this is a legally binding document and that I am giving up substantial legal rights. Electronic submission of this form constitutes my electronic signature and agreement to all terms above.

Electronic agreement via form submission is legally binding and accepted in place of a physical signature under applicable Texas law. Close ↑
